When you register for a TopDev account, you become a member of TopDev. If you do not register, you may access certain features only as a “visitor” with limited access.
In the course of operation and to comply with legal regulations and protect personal data, TopDev may modify this agreement and its privacy policy. If material changes are made, TopDev will notify you through various means, ensuring you have the opportunity to review the changes before they become effective. Your continued use of the service after the changes take effect constitutes your acceptance of the revised terms.
TopDev.vn is an online platform designed to allow users to post job listings and/or browse jobs posted by other users or interact with other users. TopDev.vn is owned and operated by Applancer JSC. The website contains and may contain information, news, opinions, text, graphics, links, digital artwork, animations, audio, video, software, images, music, sounds, and other content and data (collectively referred to as “Content”), formatted, organized, and aggregated in various forms accessible to users. These include directories, databases, and interactive areas where users can post job advertisements, upload multimedia files, register user profiles, and create self-promotional profiles ("interactive areas"). To fully use the services on the TopDev Website, you must register an account and provide certain personal information, including but not limited to your email address, to facilitate communication between you, the website, and other users. By registering, you agree to receive newsletters, emails, or other communications about TopDev products and services. If at any time you no longer wish to receive such emails, you may unsubscribe via the unsubscribe function on the website or the unsubscribe link at the bottom of TopDev emails. You acknowledge that TopDev may include interactive areas such as job listings, feedback sections, and real-time user interactions. You understand that TopDev does not control the information submitted to these areas and may allow users to create and manage such areas. However, TopDev, its parent company, subsidiaries, directors, employees, or agents are not responsible for the content posted in any interactive area. Your use and/or management of interactive areas are subject to this Agreement and any additional rules or procedures established by you or other users. You agree that TopDev does not screen information in advance and, given the goal of promoting open, unbiased communication, cannot pre-determine the accuracy or appropriateness of content submitted. TopDev is not responsible for monitoring or editing content in any interactive area, although it reserves the right to monitor and disclose content when legally required or necessary to protect users or the company. If notified of a violation, TopDev may investigate and remove or request the removal of content. TopDev reserves the right to prohibit specific actions or communication in interactive areas and may edit, refuse to post, or remove any content (in whole or in part) if it: (i) Violates this Agreement or any relevant TopDev policy; (ii) Harms the rights of other users, TopDev, or third parties; (iii) Violates applicable laws; or (iv) Is otherwise deemed inappropriate.

Except as expressly stated below, your use of the content is governed by current copyright laws and other applicable intellectual property laws. You agree and acknowledge that all content on the TopDev Website, including but not limited to resumes, is the exclusive intellectual property of the TopDev Website and Applancer. You are not permitted to alter, copy, reproduce, transmit, distribute, publish, create derivative works from, display, transfer, or exploit any part of the content, in whole or in part, for commercial purposes. However, you may: (i) create a single copy in digital or other formats so that your computer hardware and software can access and view the content; (ii) print one copy of each portion of the content; (iii) create and distribute a reasonable number of copies of the content, in whole or in part, in printed or electronic form for internal use. User-Provided ContentYou may only upload to any interactive area or transmit, send, publish, reproduce, or distribute on or through the TopDev Website content that is either not subject to any Intellectual Property Rights, or content for which the Intellectual Property Rights holder has granted explicit authorization for dissemination over the Internet and on the TopDev Website without restrictions. Any content submitted with the copyright owner's consent, where you are not the owner, must be accompanied by a statement such as “copyright owned by [name of owner]; used with permission.” By submitting content to any interactive area, you automatically grant and/or warrant that the owner of such content—whether yourself or a third party—has granted TopDev Website a royalty-free, perpetual, irrevocable, non-exclusive, unrestricted license to use, reproduce, modify, adapt, publish, translate, create derivative works from, sublicense, distribute, perform, and display such content, in whole or in part, worldwide and/or to incorporate it into other works in any form, media, or technology now known or hereafter developed, under the full scope of any Intellectual Property Rights in such content. You must comply with the provisions set out in the Order Form, the Service Agreement, and these Terms & Conditions as a prerequisite to using the Services. In the event of any breach by you of the provisions in the Order Form, Service Agreement, or these Terms & Conditions, we reserve the right to remove any of your job postings, content, or links and terminate the provision of services without refunding the Service Fee or any prepaid but unused amounts. Additionally, we reserve the right to demand compensation for damages or losses arising from your violation.
You agree to indemnify and hold harmless the TopDev Website, its parent company, subsidiaries, directors, employees, contractors, and agents from any liabilities, claims, and expenses, including reasonable attorney’s fees, arising from your breach of this Agreement, any other policy, or from your use or access of the TopDev Website or any website linked to or from it, or from your transmission of any content on the TopDev Website.
You agree to maintain the confidentiality of all information related to the Services, transactions, and/or any other data collected during transactions. You must cooperate in preventing and combating unauthorized copying or use by any third party of your job postings or other information on the Internet. You may not disclose, share, or sell any candidate information obtained through the service to any third party in any form without prior written consent from the Company. Additionally, you are responsible for safeguarding your account and password and using the account solely for your recruitment purposes as agreed in the Order Form/Service Agreement.
This Agreement constitutes the entire agreement between you and the TopDev Website, superseding any prior agreements related to the subject matter herein. The TopDev Website may revise this Agreement or any other policy at any time, and such changes will take immediate effect upon being published in a prominent area of the TopDev Website. You agree to periodically review this Agreement to stay informed of any changes. If you do not accept the changes, you must stop using the TopDev Website. Continued access or use after such changes will be deemed your acceptance of them. If any provision of this Agreement or any policy is deemed invalid or unenforceable, that portion shall be construed in accordance with applicable law to best reflect the original intent of the parties, and the remaining provisions shall remain in full force and effect. Failure by the TopDev Website to enforce any provision strictly shall not be construed as a waiver of any term or right. This Agreement shall be governed by the laws of the province or state in which the TopDev Website is based, without regard to conflict of law principles, and both you and TopDev submit to the exclusive jurisdiction of the courts in that province or state. This Agreement is personal to you and may not be assigned to any third party. All logos, affiliates, product names, trade names, or service marks appearing herein may be the trademarks or service marks of their respective owners. References to any trade names, service marks, or links to or from the TopDev Website are made solely for clarity and identification purposes and do not constitute endorsement by the TopDev Website of the products, services, or information offered by the respective owners of such names, marks, or links, nor an endorsement by those owners of the TopDev Website.
